  1. Software License Agreement
  2.  
  3. 1.   I-Magic Online grants to you 
  4. a nonexclusive, nonsublicensable, 
  5. license to use and copy the 
  6. Planetary Raiders front end software 
  7. (the "Software") subject to the 
  8. following terms.
  9.  
  10. 2.   Title, ownership rights, and
  11. intellectual property rights in and to
  12. the Software shall remain in I-Magic Online
  13. and its successors or assigns. You agree to 
  14. abide by the copyright law and all other 
  15. applicable laws of the United States
  16. including, but not limited to, export 
  17. control laws.  You acknowledge that the 
  18. Software in source code form remains a 
  19. confidential trade secret of I-MagicOnline
  20. and therefore you agree not to modify the 
  21. Software or attempt to decipher, 
  22. decompile, disassemble or reverse 
  23. engineer the Software, except to the 
  24. extent applicable laws specifically 
  25. prohibit such restriction.

  27. 3.   I-Magic Online MAKES NO 
  28. REPRESENTATIONS ABOUT THE SUITABILITY OF 
  29. THIS SOFTWARE OR ABOUT ANY CONTENT OR 
  30. INFORMATION MADE ACCESSIBLE BY THE SOFTWARE, 
  31. FOR ANY PURPOSE.  THE SOFTWARE IS PROVIDED 
  32. 'AS IS' WITHOUT EXPRESS OR IMPLIED 
  33. WARRANTIES, INCLUDING WARRANTIES OF 
  34. MERCHANTABILITY AND FITNESS FOR A 
  35. PARTICULAR PURPOSE OR NONINFRINGEMENT. 
  36. THIS SOFTWARE IS PROVIDED WITHOUT CHARGE 
  37. AND, ACCORDINGLY, I-Magic Online SHALL NOT 
  38. BE LIABLE UNDER ANY THEORY OR ANY DAMAGES 
  39. SUFFERED BY YOU OR ANY USER OF THE 
  40. SOFTWARE.

  42. 4.   You may distribute as many copies
  43. of the Software as you wish; provided 
  44. that you distribute only exact 
  45. copies of the Software with all of the 
  46. files (including this license 
  47. agreement). You are prohibited from 
  48. charging or requesting donations for the Software or media upon which the 
  49. software may be copied.  You are 
  50. prohibited from charging or requesting 
  51. donations for the act of downloading the
  52. Software (on-line transfer of the 
  53. Software via a pay service is acceptable 
  54. if no specific charge, other than a
  55. charge for time required for 
  56. downloading, is directly attributable to 
  57. the transfer).  You are prohibited from 
  58. distributing the Software via CD-ROM or 
  59. any storage medium with a capacity 
  60. exceeding 5 megabytes.

  62. 5.   This License is personal to you and 
  63. you agree not to assign your rights 
  64. herein.  This License shall be 
  65. governed by and construed in accordance 
  66. with the laws of the State of Texas and, 
  67. as to matters affecting copyrights, 
  68. trademarks and patents, by U.S. federal 
  69. law.  You agree that venue for any and 
  70. all disputes related to this license 
  71. agreement shall lie in Texas.

  73. 6.   You may not download or otherwise
  74. export or reexport the Software or any 
  75. underlying information or technology 
  76. except in full compliance with all 
  77. United States and other applicable laws 
  78. and regulations.  In particular, but 
  79. without limitation, none of the Software 
  80. or underlying information or technology 
  81. may be downloaded or otherwise exported 
  82. or reexported (I) into (or to a national 
  83. or resident of) Cuba, Haiti, Iraq,
  84. Libya, Yugoslavia, North Korea, Iran, or 
  85. Syria or (ii) to anyone on the US 
  86. Treasury Department's list of 
  87. Specially Designated Nationals or the US 
  88. Commerce Department's Table of Deny 
  89. Orders.  By downloading the Software,
  90. you are agreeing to the foregoing and 
  91. you are representing and warranting that 
  92. you are not located in, under control 
  93. of, or a national or resident of any 
  94. such country or on any such list.

  96. 7.   I-Magic Online EXPRESSLY DISCLAIMS ANY 
  97. WARRANTY FOR THE SOFTWARE.  THE SOFTWARE 
  98. AND ANY RELATED DOCUMENTATION IS 
  99. PROVIDED "AS IS" WITHOUT WARRANTY OF 
  100. ANY KIND, EITHER EXPRESS OR IMPLIED,  
  101. INCLUDING, WITHOUT LIMITATION, THE 
  102. IMPLIED WARRANTIES OR MERCHANTABILITY, 
  103. FITNESS FOR A PARTICULAR PURPOSE, OR  
  104. NONINFRINGEMENT.  THE ENTIRE RISK 
  105. ARISING OUT OF USE OR PERFORMANCE OF THE 
  106. SOFTWARE REMAINS WITH YOU. IN NO EVENT 
  107. SHALL I-Magic Online BE LIABLE FOR ANY 
  108. DAMAGES WHATSOEVER (INCLUDING, WITHOUT 
  109. LIMITATION, DAMAGES FOR LOSS OF BUSINESS 
  110. PROFIT, BUSINESS INTERRUPTION, LOSS OF 
  111. BUSINESS INFORMATION, OR ANY OTHER 
  112. PECUNIARY LOSS) ARISING OUT OF THE USE 
  113. OR INABILITY TO USE THIS I-Magic Online
  114. PRODUCT, EVEN IF I-Magic Online HAS BEEN 
  115. ADVISED OF THE POSSIBILITY OF SUCH  DAMAGES.  
  116. BECAUSE SOME STATES/JURISDICTIONS DO NOT 
  117. ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY 
  118. FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, 
  119. THE ABOVE LIMITATION MAY NOT APPLY TO 
  120. YOU.

  122. 8.   By installing, using, or 
  123. distributing the Software, you expressly 
  124. consent to the terms of this agreement.
